Construction Industry Contracts

The Construction Industry makes use of various standard form contracts which have evolved and been the subject of Court scrutiny and interpretation leading to a general understanding of the operation of their terms. Such standard forms include the JCT and NEC suites of forms which are most prevalent today.

Alternatively, Contractors and Employers may prefer to use their own standard form or terms in order to re-adjust the balance of the standard forms towards their interests or the specific requirements of the project or joint venture.

Construction contracts, as well as being subject to legislation affecting general commercial and consumer contracts are subject to industry specific legislation in terms of the Housing Grants, Construction and Regeneration Act 1998 as amended by the Local Democracy, Economic Development and Construction Act 2009, which provide requirements for payment terms and the right to refer disputes to adjudication, striking out non compliant terms and replacing them with statutory terms.
